On April, 7 there was presented a draft law, which will enable the change of the National Agency on Corruption Prevention (NACP) management and improve the efficiency of this body. The document was provided by the Minister of Justice Pavlo Petrenko; this is a collaboration of the Ministry of Justice, civil society, experts and foreign partners.
According to the Minister, the proposed model will enable removal of the shortcomings and gaps in the legislation that threaten electronic declaration proper functioning. First of all, it concerns institutional problems with the Agency management and responsibility for its activities. However, the changes will not be directly applied to the electronic declaration, people who submit declarations, etc.
It should be noted, by this draft law it is proposed to put in personal responsibility of the NACP head for the entire agency activity. Also, the introduction of the Government’s political responsibility for appointing management staff of the body is planned.
The applicants’ selection for senior positions will be realized on a competitive basis with the publicity and transparency of the process. Selection board will recommend the Government candidates who have received more than 5 out of 8 votes of its members. It’s worth adding, the draft law proposes to conduct a competition within 2 months after its entry into force.
According to the Minister of Justice, the proposed changes provide an annual independent external audit of NACP activity. In particular, the audit will be carried out by three persons who are not civil servants and who have international anti-corruption work experience. If the inspection results are negative, the Government will have the right to decide on the prosecution of the head of the Agency.
It is also proposed to restrict 50% bonuses of position salary charging by NACP management to themselves.
