The Verkhovna Rada has adopted in the first reading a draft law No. 6427-d “On the Constitutional Court of Ukraine”, which defines the procedure for the organization and operation of the body, the status of the judges of the Constitutional Court, the grounds, and procedure for court applications, trial procedures, and the judgment executions. The decision was supported by 231 MPs.
According to the text of the law, the Constitutional Court ensures the supremacy of the Constitution, decides on compliance with its laws and other acts and provides an official interpretation of the basic law of the state.
It should be noted that the Constitutional Court provides conclusions on the compliance of the Constitution with laws and acts at the request of the President of Ukraine or at least forty-five people’s deputies of Ukraine or the Cabinet of Ministers of Ukraine. Also, the Court deals with the constitutionality of laws under a constitutional complaint of a person who believes that the law of Ukraine is in conflict with the Constitution in the final judicial decision in his case.
According to the bill, the composition of the Constitutional Court is 18 judges. The President, the Verkhovna Rada and the Congress of Judges of Ukraine appoint six judges.
Also, the bill improves the competitive principles for selecting juridical candidates of the Constitutional Court; excludes the provision on the need to pay a fee for submission of a constitutional complaint by the person, etc.
